Menasco v. Davidson

Millstein Fellner represented the estate planning attorneys Davidson Estate Law against allegations of financial elder abuse, fraud, and constructive fraud brought by the estate of a deceased client. On March 15, 2023 the Alameda County Superior Court granted Millstein Fellner’s motion for judgment on the pleadings as to all claims for Plaintiff’s failure to allege sufficient facts regarding Davidson’s alleged involvement in a fraud. The court also granted Plaintiff leave to amend his complaint if he could make good faith allegations to cure the defects identified by Millstein Fellner.  Plaintiff could not, in good faith, assert claims against Davidson that complied with the law, ultimately resulting in dismissal and judgment in favor of Davidson in the case.
